Terms of Service

1. Who we are

"Swapnil Service Store" (the "Service") is operated by Swapnil Popat ("we", "us"), based in India. By placing an order, creating an account or otherwise using the Service you agree to these Terms. If you do not agree, please do not use the Service.

2. Services offered

We offer productized consulting, architecture review, IIoT / ThingWorx, web/AI advisory and career consultations. Each service page describes its scope, duration, delivery mode and deliverables. Anything outside that description is out of scope unless agreed in writing.

The Service is an advisory/consulting engagement. It is not a guarantee of any specific business, technical, hiring or project outcome.

3. Eligibility & accounts

You must be at least 18 years old (or have a guardian's consent) and able to enter a binding contract. You are responsible for the accuracy of the information you provide at checkout — incorrect contact details may delay or prevent delivery.

4. Orders, pricing & payments

• All prices are listed in Indian Rupees (INR) and are introductory; we may revise pricing at any time, but the price shown at the moment you complete checkout is the price you pay for that order.
• Taxes/GST are not currently applicable unless explicitly indicated.
• Payments are processed by Razorpay. We do not store card or UPI credentials.
• An order is confirmed only after the Razorpay payment is verified and the order status becomes PAID.
• For "Custom Project Quote" the listed price is zero; pricing is agreed separately after we review your requirement.

5. Scheduling & delivery

After a successful payment we contact you within 24–48 business hours to schedule the session or kick off async review work. Delivery timelines vary by service and are stated on each service page. You agree to provide the context and access (documents, repos, demo accounts) we reasonably need to deliver the work.

6. Cancellations & refunds

Cancellation and refund handling is governed by our Refund & Cancellation Policy, which forms part of these Terms.

7. Intellectual property

Deliverables created specifically for you (e.g. a review document prepared for your codebase) may be used by you internally for the purpose described. Templates, methodologies, frameworks, prior know-how and any reusable assets we bring to the engagement remain ours. You may not resell, sublicense or publicly republish deliverables without prior written consent.

8. Confidentiality

We treat non-public information you share (architecture diagrams, code, business context) as confidential and use it only to deliver the engagement. We are happy to sign a mutual NDA on request before kickoff — mention it in the checkout requirement field.

9. Acceptable use

You agree not to use the Service for anything unlawful, abusive, or that infringes the rights of others. We may refuse or cancel service (with refund of any undelivered portion) if a request violates this clause.

10. Disclaimers

The Service is provided on an "as-is" and "as-available" basis. Recommendations are based on the information you provide and our professional judgement at the time. You are responsible for any business or technical decisions you take based on our advice.

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to an order is limited to the amount actually paid by you for that order. We are not liable for indirect, incidental, consequential or punitive damages, or for lost profits, revenue or data.

12. Third-party services

The Service relies on third-party providers (e.g. Razorpay for payments, Google Meet / Microsoft Teams for calls, email providers). Your use of those services is also governed by their own terms; we are not responsible for outages or actions on their side.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date reflects the latest version. Continued use of the Service after an update means you accept the revised Terms.

14. Governing law & disputes

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the competent courts in Pune, Maharashtra, India. We encourage you to contact us first so we can try to resolve things directly.
